Tort and Liability Description  

TL01 Accessible Guidelines- ADAAG

Explains federal guidelines for accessibility to places of public accommodation and commercial facilities by individuals with disabilities are required by the Americans with Disabilities Act of 1990.

TL02 Best Defense is a Good Road
Federal Highway Administration       16 Minutes

This tape shows how lawsuits can be minimized through good management, proper record keeping, and routine inspection by local road officials.  A court scene presents a road superintendent who is accused of being negligent in repairing a damaged road sign, but is found innocent because of proper management and documentation.

TL03 "Caution, Litigation Ahead: The Road to Effective Risk Management"

An accident involves several factors: the driver, the vehicle, and the roadway conditions.  This video discusses different agencies experiences and take the viewer on a tour to look at potential problem areas along the streets and highways.

TL04 How to Give a Deposition
Pennsylvania Department of Transportation       17 Minutes

Excellent portrayal of highway officials giving depositions.  How to respond to attorney's questions.  How to avoid problem responses.  What to say and how to say it. 

TL05 "Local Government on Trail Part 1, The Background"
Pennsylvania Department of Transportation       41 Minutes

Demonstrates the various aspects of a court case involving a contractor and a township in Pennsylvania when an accident occurs on a roadway.  Shows how the case develops from the time of the accident through the complaint, discovery process, jury trial, and outcome.  The township, which has 28 miles of road, is representative of any rural municipality.  The program will familiarize public works officials with legal and court procedures they would encounter in a lawsuit.

TL06 "Local Government on Trail Part 2, The Trail"

(See part 1 description) Part 2 depicts the trial.  What to expect if you are involved in a trial, including jury selection, opening statements, attorney presentation, witnesses, and cross examination.

TL07 Maintenance Tort Liability
Louisiana Department of Transportation       40 Miuntes

This video will give a brief background of the situation and explains the seriousness of the problem, legal terms and explanations of present laws governing this area, maintenance related situations that resulted in lawsuits against the department or its employees, and the summary of court cases who was held accountable and why.

The video discuss women's growing role in highway construction and the legalities agencies may face.

TL09 Risk Management for Small Communities
Oklahoma University       52 Minutes

Small communities around the country are closing parks due to the number of lawsuits are increasing.  Insurance to protect against risks are unavailable or unaffordable.  The video discusses how communities can manage the risks it faces.

TL10 Tort Awareness
Pennsylvania Department of Transportation       34 Minutes

The program discusses tort liability and why it is such a concern for the department.  The video will cover understanding of torts and how they came about, recognize the extent of the tort problem, and build awareness of legal factors.

TL11 Torts are Everybody's Business
Pennsylvania Department of Transportation       5 Minutes

Discusses how well all employees in a public works operation can be affected by civil suits against them or their municipalities.
